1. DEFINITION
BankofAthletes Privacy Policy explains herein and how their subsidiaries handles personal information when you use BankofAthletes services, including information supplied when you become a BankofAthletes Client. In addition, the following describes privacy practices specific to BankofAthletes. To understand how we treat the information that has been given by the Client for the use of BankofAthletes services, read this Policy and the Terms of Use and Contract of BankofAthletes .
This Privacy Policy will go into effect on August 1, 2007 for the Users registered before that date and for the Users registered after that date.
As for the nature of the services provided by BankofAthletes, it collects and exposes the information inserted by the Clients. This Privacy Policy explains how BankofAthletes collect the information from its Client and how it will disseminate, in order to demonstrate absolute transparency as for this important subject. When registering and/or navigating the site, the Client and/or Visitor sanctions tacitly on the usage of his or personal information in agreement with this Policy herein.
With this Policy, BankofAthletes want to demonstrate that the privacy of the Client's information is very important, and in favor of that, precautions and cautions are taken to protect him or her by using the most complete and effective mechanisms of computer safety.
This document is a fundamental part of the Terms of Use and Contract of BankofAthletes. By its approval when registering, the User accepts the Policy herein.
2. INFORMATION FOR THE CLIENT/USER
2.1 As for the activities not related to account:
The User can access the content of the Website without having an account of BankofAthletes, conversely the User will just be able to visualize a limited number of pages.
2.2 As for activities related to account:
To accomplish certain activities on the BankofAthletes Website - such as an upload of athlete's and/or coach's information of text, photos, and videos and/or complete visualization of the data bank of BankofAthletes - it is necessary to have a BankofAthletes account. When creating this account, BankofAthletes will request some personal information, such as an e-mail address and a password that will be used to protect the Client´s account from non authorized accesses. The BankofAthletes account allows the Client to access several other services which will also require registration.
2.3 As for the use:
We may document information on your usage on the BankofAthletes site , such as, your preferences of your exclusive area, insertion of athlete and/or coach, the contacts you communicate with, the frequency and size of data transfers, as well as information you display or click on the site (including UI elements, settings, and other information). If you are logged in, we may associate that information with your account. We may use clear GIFs (a.k.a. "Web Beacons" - see more information below) in HTML based emails sent to our Users, to track which emails are opened by recipients.
2.4 As for the contents uploaded to the Website:
All personal information, images or video content that the Client voluntarily discloses online (on your exclusive area) becomes publicly available and can be collected and used by others.
3. CONSENT
When using this site, the User sanctions the gathering and use of the information, as described herein. The User is required to revise this Privacy Policies for updates; hence, consulting it periodically.
4. COLLECTED INFORMATION
The gateway to benefit from the services of BankofAthletes is to register informing some complete and exact personal data i.e. Personal Information. May well be requested, received and stored the following data in order to operate in the BankofAthletes Website: email and password for login, and personal information: full name, nickname or pseudonym, date of birth, nationality, address, telephone for contact, gender, and profession. BankofAthletes can confirm the informed personal data by consulting public entities, specialized companies, or databases in order to deliberately certified the data prearranged. The information that BankofAthletes obtains from these entities will be treated in a confidential way.
At any moment the Client registered can request the extermination or removal of his or her page, as well as the elimination of his or her data in the data bank of the company. For more information, read item "Extinction" below.
BankofAthletes collects and stores automatically some information of the Client's and/or Visitor's activity on the site. Such information can include URL from where they come from (be from BankofAthletes or not), which URL is accessed afterwards (be from BankofAthletes or not), which navigator is being used, and his or her IPs of access. Also the visited pages, the accomplished searches, the announcements clicked, updated information, among other information can be stored and kept.
If the User - Client or Visitor - sends correspondences by e-mails or letters, or if other Users or third parties send correspondences about the activities or other Users' information on the site, BankofAthletes will collect and store personal information of sender, as well as his or her e-mail address.
5. USE OF THE INFORMATION BY BANKOFATHLETES
To provide an excellent service so that the Client can accomplish operations in an agile and safe way, BankofAthletes requests some personal character data, including an e-mail address. The information collected allows BankofAthletes to offer its Client personalized services and functionalities that better adapt to his or her needs with the intention that his or her experiences are the most comfortable possible. The personal information and athlete/coach information have the following purposes:
- To help the User - Visitor or Client - to enter in direct contact if any opportunity of negotiation of an athlete and/or coach arises. In this case, BankofAthletes will provide the interested parties contact data (name, telephones and e-mail), through the field Contact in the athlete/coach page.
- To adapt a layout of the Website to the Client's preferences, and User's statistics for monitoring his or her athlete and/or coach. Always seeking to offer better services or to provide him or her related information.
- To improve commercial initiatives and promotions, to analyze the pages visited in the searches accomplished by the Users, to improve the offer of "products"(athlete/coach) and to personalize the contents, the layout and the services.
- To send information or messages by e-mail about new services, to show publicity or promotions, banners of interest to the User, news of BankofAthletes, besides the information expressly authorized in the section of preferences. If the User prefers, he or she can request the exclusion of the newsletter that sends promotional or advertising information. To do this, the Client should consult his or her exclusive area.
- In case if there are promotions and/or contests promoted by BankofAthletes, Winners authorizes expressly to disseminate his or her name, personal data and images, for the means and form that considers convenient, for advertising ends and/or promotion, without any right of compensation.
- To share athletes/coaches information with the interested parties, be associations, natural or legal person, clubs, whoever is involved in football and contributes to facilitating the operations through BankofAthletes, as (without limiting the) services by bulk mail, e-mail, correspondence, call centers or fidelity programs, among others. BankofAthletes will pledge for certain standards to ensue, in signature of agreements or agreements whose purpose is, the privacy of the Client's personal information and the information inserted by the same. However, BankofAthletes does not take the responsibility for the improper use of the Client´s personal information, as well as the athlete/coach information inserted by the same, on the part of this natural or legal person and, association, clubs, etc. These interested parties will be the main viewer of the Clients information. The Client will receive direct contact concerning the interest from a club or association on his or her athletes and/or coaches and will be his or her free will to negotiate accordingly. In case the Client supplies by its own initiative additional information to these interested parties, BankofAthletes does not take the responsibility for the legitimacy of the given ones.
6. COOKIES
The User - Visitor and or Client - of the BankofAthletes Website asserts to accept that BankofAthletes can use a monitoring system by using cookies. The cookies are small files that settle in the hard disk, with a limited duration of time in order to personalize services. Some functionality will be offered with the use of the cookies. The cookies are used with the purpose of finding the interest, the behavior, and the demography of Visitors and Clients, and by this, understanding better his or her needs and interests to provide a better service or related information. The information obtained through cookies will also be used to analyze the pages navigated by the Visitor or Client, the accomplished searches, to show publicity or promotions, banners of interest, news, to improve contents of the Website, and to personalize those contents, presentation and services; the use of cookies can also be available to promote and to accomplish the rules and safety of the Website. BankofAthletes can add cookies in the e-mails sent to measure the effectiveness of the promotions. The cookie won't be used in another strange purpose other than for the operation of BankofAthletes Website.
The installation, permanence, and existence of cookies in the User's computer depends on his or her exclusive will and therefore can be eliminated of his or her computer whenever desired. To know how to remove cookies, it is necessary to go to the ¨Help¨ menu on the toolbar of the navigator.
Additionally, you can find cookies or other similar systems installed by third parties in certain pages of the BankofAthletes Website. For instance, there might be a built-in cookie when navigating on a page created by a Client.
Finally, this Policy covers the use cookies by this Website and not the cookies used on the Client´s part. BankofAthletes does not have control of the cookies use by third parties.
7. WEB BEACONS
A Web Beacon is an electronic image, also called semgle-pixel (1 x 1) or transparent pixel, which is a code inserted on a web page. A Web Beacon has similar purposes to Cookies. Additionally, a Web Beacon is used to measure traffic patterns of the Users on a page, and also has an objective of maximizing the flow of traffic through the Web.
8. EXTINCTION
The Client, when registering, sanctions this Privacy Policy, and therefore has the right to access, to cancel and to update his or her personal data and the data uploaded of an athlete or coach, as well as to oppose the usage, and to be informed of the executed extinctions. The Client guarantees truthfulness, accuracy, validity and authenticity of the personal data, and commits to maintain them properly updated.
Once registered in the BankofAthletes Website¸ the Client can revise and change the information that he or she supplied during the registering process on his or her exclusive area, such as:
- The email and login password: without harm of the changes made, BankofAthletes will conserve the original personal data for safety and control of fraud;
- Registering information: personal information (name, date of birth, nationality, address, telephone number, post office box, etc).
- Upload information of an athlete: personal information (name, date of birth, nationality, position, contact, photos, videos and etc.).
- Upload information of a coach: personal information (name, date of birth, nationality, position, contact, photos, videos, and etc.).
In certain cases, in the files of BankofAthletes will be kept the information of removal request, for the purpose of solution of disputes or complaints, detection of problems or incidents and to solve them and to maintain the determination in the Terms of Use and Contract. In any case, the information inserted by the Client won't be immediately removed from the files as for legal and technical reasons, including support and safety systems.
The User should update his or her personal information and information of his or her bank of athletes regularly, in order to maintain the data updated so that other Users can contact him or her when interested. To do any modification to the registering information supplied, enter your exclusive area by using your login information or by clicking on "MY ACCOUNT".
9. CONFIDENTIALITY
BankofAthletes only collects the information supplied by the own User/Client and by his/her permission. The information inserted are achieved when a User decides to join and become a BankofAthletes' Client.
All BankofAthletes collaborators are obligated to save and keep your privacy and confidentiality rights.
